1. Platform Description

Welcome to Shomay ("we," "us," or "our"), an independently operated digital platform. These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications (iOS and Android), and related services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

Shomay is a hyperlocal product discovery platform that provides users with information about products available at nearby physical retail stores.

The Platform:

• Does not sell products
• Does not process payments
• Does not facilitate transactions
• Does not act as an agent for Users or Merchants

All purchases occur directly between Users and Merchants.

2. Definitions

• "User" / "You" refers to any individual accessing or using the Platform.
• "Merchant" / "Store" refers to retail establishments whose product information appears on the Platform.
• "Content" refers to all information, text, images, listings, AI-generated visuals, graphics, and materials available on the Platform.
• "Account" refers to a registered user profile.
• "AI Content" refers to images, previews, model visuals, or simulations generated or enhanced using artificial intelligence technologies.

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Platform under applicable laws

We do not knowingly permit individuals under 18 to create accounts. If discovered, such accounts may be terminated.

3.2 Account Creation

To access certain features, you must create an account by providing accurate and complete information, which may include:

• Full name
• Email address (currently Gmail supported)
• Password

Phone numbers are collected only for store owner accounts. We may collect user phone numbers in the future for feature enhancements.

Product details are provided by Merchants or third parties. We do not guarantee:

• Completeness
• Reliability
• Real-time stock

Users should verify with stores before visiting.

5.2 No Guarantee of Availability

Display does not guarantee:

• Stock availability
• Quantity accuracy
• Product specifications

5.3 Pricing

Prices are set by Merchants and subject to change. We are not responsible for pricing disputes.

6. No Transaction Facilitation

Shomay does not:

• Process payments
• Handle refunds
• Manage returns
• Guarantee product authenticity

All transactions occur directly between User and Merchant.

7. Advertising and Sponsored Content

The Platform may display:

• Promotional banners
• Sponsored listings
• Discount offers
• Third-party advertisements

Sponsored content may receive enhanced visibility.

We do not guarantee:

• Accuracy of promotions
• Offer fulfillment
• Merchant compliance

We may integrate third-party advertising networks (including Google Ads or similar services).

8. AI-Generated Images and Virtual Try-On

The Platform may use AI technologies to generate or enhance certain images or visual simulations.

8.1 Nature of AI Content

AI Content may include:

• AI-generated fashion models
• Virtual try-on simulations
• Digitally rendered outfits
• AI styling previews
• Enhanced product images

These images may not depict real individuals.

8.2 Illustrative Purpose Only

AI Content is for illustrative reference only. It may differ from real-world:

Use of AI features is at your discretion.

9. Intellectual Property

The Platform and all Content (including AI Content) are owned by or licensed to Shomay.

User feedback grants us a royalty-free license to use it.

You agree to indemnify and hold Shomay harmless from claims arising from:

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Courts located in Hyderabad, Telangana, India shall have exclusive jurisdiction.
